Terms & Conditions
1. Scope
These Terms & Conditions (T&C) apply to all contracts concluded between Glavienne Designs e.U., based in Austria, and customers via the online shop. Any deviating conditions of the customer shall not apply unless Glavienne Designs e.U. has expressly agreed to them in writing.
2. Subject of Agreement
Glavienne Designs e.U. provides virtual furnishing services ("Virtual Staging"). The customer provides a photograph of an empty or furnished room, which will be virtually furnished by Glavienne Designs e.U.. The final renderings are delivered to the customer in digital form.
3. Conclusion of Contract
The presentation of services in the online shop does not constitute a legally binding offer, but an invitation to place an order. By completing the order process, the customer submits a binding offer. The contract is concluded once Glavienne Designs e.U. confirms the order by email.
4. Prices and Payment
All prices are stated in Euro (EUR), including statutory VAT. Payment must be made using the payment methods offered in the online shop. Processing will only begin once full payment has been received.
5. Delivery
The delivery of virtual renderings is made exclusively in digital form to the email address provided by the customer or via download link.
6. Right of Withdrawal
Consumers residing in the European Union generally have a statutory right of withdrawal. However, since the renderings are custom digital content made according to the customer’s specifications, the right of withdrawal expires in accordance with § 18 FAGG (Austria) once Glavienne Designs e.U. has started processing with the customer’s express consent.
7. Copyright of Provided Images
The customer warrants that they hold all necessary rights to the provided images and that such images are free of third-party rights, including but not limited to copyrights, trademarks, or personal rights. The customer grants Glavienne Designs e.U. a simple, non-transferable right to use the images solely for the purpose of fulfilling the contract.
The customer indemnifies Glavienne Designs e.U. against any third-party claims arising from the unlawful use of the provided images and agrees to bear all costs incurred in this context, including necessary legal defense costs.
8. Use of External Service Providers
For the provision of the services, Glavienne Designs e.U. uses external service providers to process the images provided by the customer. The transmission of the images to such providers is carried out exclusively for the purpose of fulfilling the contract. Any other use or disclosure by the service provider is excluded. The customer expressly agrees to this processing.
9. Liability
Glavienne Designs e.U. shall be fully liable for intent and gross negligence. For slight negligence, Glavienne Designs e.U. shall only be liable in the event of a breach of essential contractual obligations, and such liability shall be limited to the foreseeable damage typical for the contract.
10. Applicable Law and Jurisdiction
The laws of the Republic of Austria shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a consumer with habitual residence in another EU Member State, the mandatory consumer protection provisions of that country remain unaffected. Place of jurisdiction for business customers is Vienna.
